The Kachess CC&Rs Article IV Section 2 state that "all lots,
designated single family, shall be used exclusively for private single
family residence consisting of single residential dwellings and such
outbuildings (garage, patio structure) as are consistent with a
permanent or recreational residence." Kachess owners have expressed the
desire to lease their residence on long term leases. The Board of
Directors has put together an agreement, to assist the property owner in
protecting their interest.
Commercial operations in the Kachess Community are
against the CC&Rs and in violation of the Kittitas County Zoning
ordinance. Commercial operations can be described as a property either
owned by a corporation, limited partnership, or single owner that is
advertised on a commercial Web Site, Bulletin Board, magazine or
publication that encourages and allows short term rentals such as
overnight, weekend, one week, or anything less than a normal lease
period of six months or longer. Thus, only long term lease agreements
are allowed in the Kachess Community (and the Kittitas County Zoning
ordinance).
The purpose of the attached agreement is to insure
that lessees of property in the Kachess Community understand the rules
and regulations for which the property owner is held accountable.
If an owner wishes to enter into a lease agreement,
they should have the lessee sign the attached agreement and return a
copy, along with a copy of the lease agreement, to the President of the
Board of Directors.
